Saturday, June 4th, 2011Can employers in California check the criminal background of an applicant more than seven years in the past?
In California, criminal convictions can only be reported for seven years unless another law requires employers to look deeper into your background. (CA Civil Code 1786.18)
Does anyone know if this is always followed? I have a misdemeanor from 14 years ago, and it looks like I don't have to inform employers of it on my application or in an interview if they ask.

What is REALLY involved in typical background check?
I am a CA resident and have a 4-year-old misdemeanor in state of Iowa (got while travelling thru IA). I am looking for a job in CA, and have heard that typically, an employer that conducts background checks looks for felonies abroad, but misdemeanors they look locally (usually, the county in which you are applying). While this is proabably not an absolute, I am wondering if anybody with actual or relevant experience in such matters can tell me if that is ordinarily the case. I have heard that in CA, marijuana related misdemeanors more than 2 years old do not need to be disclosed, so I consulted a free legal service, but am still awaiting their advice. In the meantime though, I need to continue looking for jobs and would like some sound feedback so that when I am asked about my misdemeanor background on the job applications I might have a better understanding of how much of a risk I would be taking if I said "No."
As a background screening professional, it is my interpretation that the CA Fair Credit Reporting Act does prohibit the disclosure of a misdemeanor marijuana conviction if it falls outside of a 2 year scope. Additionally, if you have never resided in Iowa, it is likely that the case will not be discovered by the background screening company. If the company utilizes a multi state database search and the county in IA sells their records, it is possible that the case could be discovered and reported. Database companies rarely comply with the FCRA.
